Scotland’s Migration Service has supported many small and medium-sized businesses to understand sponsor licence requirements and prepare for Home Office compliance checks.

This case study is based on multiple anonymised client interactions to protect confidentiality.

How Scotland’s Migration Service supported employers

Several employers contacted Scotland’s Migration Service for support with sponsorship, compliance, and preparing for potential Home Office audits.

Many were unsure how the system worked in practice, particularly around certificates of sponsorship, salary requirements, and audit expectations.

Across a series of one-to-one advice sessions, Scotland’s Migration Service provided guidance on key areas of sponsorship.

This included:

  • Clarifying ongoing sponsor duties and responsibilities
  • Outlining required documentation and best practice in record-keeping for sponsor compliance
  • Explaining common issues in audits and areas which are often overlooked by the sponsor.

Employers were also supported to better understand how audits operate in practice.

This included:

  • outlining the usual steps involved in an audit
  • advising on how to respond to notifications of an audit
  • offering further legal support to help prepare for potential audits or review compliance.

Some employers had already experienced a Home Office compliance audit or were preparing for one.

In these cases, Scotland’s Migration Service explained how audits are assessed by the Home Office. This included not only reviewing HR systems but also assessing the legitimacy of the business and the genuine need to hire overseas workers.

Employers were also supported to understand next steps following adverse outcomes, including cooling-off periods before reapplying for a sponsor licence.

Through this support, employers gained a clearer understanding of:

  • their responsibilities as a sponsor
  • how to prepare for compliance checks
  • how to strengthen internal processes and record keeping.

This helped reduce uncertainty and gave employers more confidence when navigating the sponsorship system.
